You don't "invoke" nullification. Nullification works on the principle that a jury cannot be held responsible for a "wrong" decision.
Here is an example: A man's daughter is raped and the rapist walks (see any yuropoor nation); the man goes and kills the rapist. He gets charged with murder and goes to trial. The entire jury say's "not guilty" to all charges regardless of evidence shown and the man walks since a the jury makes the call on "guilt" or "innocence" and judges only handle sentencing.

According to the American Constitution, a person cannot be tried for the same crime twice, while a citizen also has a right to a trial by jury. So, if the jury decides that, yes, as person is guilty, but then goes ahead and return an innocent verdict for whatever reason (sometimes if the jury doesn't agree with the law, or if they think the crime was justified or something) then it's known as jury nullification and the accused is let free and cannot be tried again. Interesting quirk of our Constitution, and judges and lawyers hate this.
