No, because if something goes wrong, I rather doubt the programmer is going to prison. Humans might not be perfect decision makers, but because of our innate selfishness and mortality, someone with the power to kill will consider whether that decision will ultimately fuck up his life by landing him in Leavenworth or worse. A computer doesn't worry about that, which makes its decision-making incentives suspect. If its not worried about consequences if it fucks up, it doesn't deserve to have the power to kill.
