Generally its going to come down to radar and gps data to verify the location of the object. Flying in "im not touching you" legal range may be legal, but annoying. We have a long history of using such observation tools, going back to the hot air balloon to look over fields and borders and entrenched positions. Maybe it was in international water, maybe not, we havent gotten to see the raw data and likely wont.
The thing with drones is that its lower risk. No human life involved. That means there's less pressure to retaliate, and less risk to attack it. Also softer target. hence why the Iranians chose the GH to hit, and not, say, an F-18 doing a lazy patrol.
