It doesn't actually upsample, it stores it as a 48kHz file, so it's sped up, and plays it back slower, so it's played at it's original speed
The drawback is that not every decoder will recognize that the file is 44.1kHz and can be played faster, so you have the option to resample so it will just werk everywhere
For real time you have to resample though

How the designers think a power hungry codec is going to work well on mobile devices is beyond me. Exotic compression schemes have been tried time and again, and they have all failed.

While a codec is in open development the focus is on code clarity, not performance. The encoder is not even multi threaded yet.

It already takes days to transcode a series to HEVC, I'd rather that not take even longer

I'll bet you I can resample back and forth between 44.1 khz and 48 khz over 1000 times and give it to an "audiophile" and they'd still cum their pants just because it's 24-bit flac. The effect of upsampling is negligible with modern software. It's not a real issue anymore.

We're not discussing lossless codecs here by the way. Opus is a LOSSY codec, expect loss. You want bit-perfect audio? Use a lossless format in the appropriate sample rate and bit depth for the source audio.

Matroska and Opus are already widely adopted though
