Worked at a tech law firm as an intern.

You'd be amazed at the amount of shit people and companies have pulled in law suits regarding tech products. Car accidents, falling down the stairs, malware from fake fishing sites, and a bunch of other things have been blamed on software before despite it being the user's fault entirely. They need to have these lengthy ToS.

The licence explain what you can do with the software.
The ToS explains how you can use a service, how they use your data, how they can delete your account etc...

The FSF actually recommends using a more permissive license like apache 2 for things like scripts which are shorter then ~300 lines or so.

if i ever have to write a tos, it would be less than one page. most important rule would be "don't be a nigger".

Let's say I made an online game that has maybe a few dozen users. If you join a game it just gives you an automatic guest username, although you can set a display name if you want and a username/password if you want to track your game history better. Beyond that there's nothing, not even a chat system or a way to contact me. Do I need a TOS and/or Privacy Policy to not get fucked by lawyers?

Lawyers are already targeted as a dying breed as automation is cutting into their work, like accountants. It'll be good in 20 years when there's 1 lawyer for every 20 today, but unfortunately the system we've forged will carry on.

They are just replacing some of the grunt work of searching through cases and emails. They aren't going away.
