The problem is it misleads the public. If he were to come out and say that Tesla increased profits by 100% the stock would go flying up. And if it isnt true he screwed a lot of people into buying an overpriced stock. His tweet wasnt that extreme but its the same concept.

He literally said it outside of market hours and corrected himself before the market opened. And there is a high probability that Tesla will in fact make 500k cars.

He is in trouble because he gave "new" information about the company not through proper means. Anything new he says about the company that could affect the stock price is under a lot of scrutiny. Not to mention what he tweeted was material different to what he told the public a few months ago about the amount of cars they are producing.

He's a company representative and his words carry weight. The price of stock is impacted by information about the company and it is the fiduciary responsibility of the company to provide the most accurate information that they can (or at least as the law demands). Musk shot his mouth off on Twitter, as a company representative, and misled the public as to the actual state of his company, which subsequently impacted the stock price. At best it was negligent, at worst outright fraudulent. Yeah to a certain degree you're gambling on the stock market but it's not RNG, you're gambling on the future of a company and relying on information from the company and trusted third parties to make those decisions.

Tesla will be shipping at least 100k cars this quarter based on VIN's reported this far, and can grow production to 130k cars per quarter easily without the China factory with small capital investments, or by building another tent at Fremont. Also, the tweet says made, not sold, so the statement isn't affected by shipping delays.

He could very well fix this by making the statement true and actually making 500k cars by year end. He wouldn't be wrong.

You imply that the company sells _all_ shares to the public when most of them keep more than 50% outside of the market. They pull a little bit of capital from investors, but that capital isn't used to expand operations but to pay the executives and directors. That's why it has nothing to do with business operations.

It's not like the Virigina Company which started entirely buy selling shares of stock in order to get supplies, ships, etc. to colonize the New World.
