Given that he was with the talks of Saudi and had verbal agreements to go private, given that he'd even hired person who specializes in taking a company private, given that funding hasn't been an issue for Tesla or Elon Musk for that matter, it would be hard sell to say Elon is being reckless when the statement "Funding secured" reflects the high confidence level of Elon for his funding.

I don't think SEC thought this through with their lawsuit. Their case depends on a weak interpretation of word choice. This certainly does not have any power of making Elon resign from the company or forcing the board members to add in two independent board members.
