There's one really telling part about the judgment, and that's the response to the suggestion by Ulbricht's lawyer that Silk Road actually reduced social harm by removing middlemen and face to face contact from the drug distribution structure.
This is absolutely, unambiguously, unequivocally true. An end user being able to buy drugs more or less from the manufacturer (or at least very high level suppliers) removes every piece of violence that attends street level drug supply, mid level drug dealing, and the general criminal networks that maintain drug distribution at the lower levels.
You can ignore everything else, but it is impossible to deny that there is a massive reduction in social harm and potential harm when drugs are distributed directly by post rather than in person.
The judge completely disagreed, threw that suggestion away and moved on. That, more than anything else, made it clear just how partisan this case was. The judge had a mandate to throw Ross under the bus, so she did. There was no weighing of competing circumstances, no consideration of broader social concerns, no actual engagement with what he had done. It was a politicised witch hunt from "drugs r bad" psychopaths in power whose entire goal was to make an example of him, regardless of reality.
