There's no reason to make it law. Leave it up to each individual business. If you don't want to go to a place that allows smoking, you're not forced too. I prefer to eat in a non-smoking environment, so I would choose restaurants that don't allow smoking over ones that do.

The vast majority of restaurants would allow smoking. I remember back when smoking was legal inside, pretty much every restaurant smelled like smoke. Now they don't.
