Because it's been well-established for the past several years through several news stories that prenups are routinely thrown out of court for either the most bullshit technical legal reasons (e.g. "I was coerced into signing it") or literally for no reason other than the judge thinks the agreement was unfair even though both parties signed to it, and then voids it
