Void Contracts

I just financed a used car from a large dealership in BC, Canada. It's a 2018 Audi A5 coupe. But not quite. The car's emblems have been replaced by S5 emblems, it's got an MTM logo on the back (which is actually a little crooked), and both the gearshift and key fob have "RS" on them.

It doesn't stop there. The grille looks like it's off an RS model with the honeycomb pattern and it doesn't even have threaded holes for a front license plate, which is required by law in my province. There's also an aftermarket skirt on the front bumper that isn't mounted properly. It's got little gaps and isn't quite flush with the rest of the bumper.

Upon startup, the screen reads "A5" while it loads up. The insurance says it's an A5. The salesman (who is currently in training) introduced the car as an A5. I asked him why it says S5 and RS all over it, and his response was "I don't know". During the test drive, the dealership's key tag read "Used 2018 Audi S5 Coupe"

I figured the salesman made a simple mistake and all the emblems and extra shit, along with the price, led me to believe I was purchasing an S5. I know, I'm a fuckin retard.

So I signed my life away and drove off the lot. Since I'm so goddamn brilliant I did some research after getting home. The car is actually a standard 2018 A5 that someone put stickers on in an effort to look like they were rich, I guess. For the price I paid, I could have bought a brand new never driven 2018 S5 from an actual Audi dealership.

While I was deciding exactly how I was going to kill myself, I was reading the contract I should never have signed. Turns out there's a few errors on it. The contract states that the vehicle is a 2018 Audi A5 Technik 4-door Sportback. Brand new, not used. The car I received was a Technik, but it's a two-door coupe.

I've been calling the dealership to unwind the deal and I've just been getting fucked around. They tell me the manager is in a meeting, or busy, or he left early, or whatever else.

I finally drove down there to try and get shit sorted out. They basically laughed at me and said "as soon as you drove off the lot that was it"

I didn't tell them about the errors in the contract. Would it be worth hiring a lawyer to get things moving? I've already been in touch with the vehicle sales authority in my area and they said I've got the right to file a formal complaint even without the contract shit. I feel misled, but most of all I feel like just the biggest fuckin retard to ever live and I should cut my nuts off so I don't contaminate the gene pool. I don't even want a refund on my first payment, I just want to return this fake ass knockoff car so I can get on with my life.


tl;dr - Can a contract be voided due to a clerical error?

Not sure for BC, but I'm pretty sure there is buy protection laws Alberta. Maybe start looking at the rules put in place by the province. Don't let the dealership tell you what's what. If you get no place there, take it to your local news station. They love doing stories on shit like this.

I was thinking maybe the car was from Alberta because you don't need front plates there. Why would a dealership accept a used vehicle that'll potentially get the buyer a $109 ticket for not properly displaying a front plate? But yeah, I bought it on impulse. Caved into their sales tactics cause I'm weak and thought the car was something it wasn't.

I was firmly committed to not leave the lot until they took the car back and unwound the deal. I was clearly choked, but I didn't want to get kicked out cause I still want to work with them. It's really getting to that point now, though.

Dude- 100%- This is a troll post... in 2 seconds upon seeing that the car is not the car i thought i was buying, and the contract is not the car i thought i was buying. Anyone whos fucking normal would hire a lawyer and take a giant dildo and shove it far up there ass and claim fraud; and say you where duped and you really thought this was that car and blah blah blah blah.

Holy fucking hell, like even knowing all this information i would sign the contract, say a friend said its not the same car, get another audi dealership to confirm its not the car, get a lisences mechanic to confirm its not the car... double check the paperwork that its not the car.. and then proceeed with a lawsuit about how raped and violated you seem and you can never trust another car dealership again.

This will work, provided the paperwork claims its a different car then what you where sold. Period. You are looking at around 120-160k out of court settlement for this type of a case.

Yeah since it was legalized it's been harder to get, there used to be shops around everywhere. I'm not really going to complain about quality I'm not picky but it's definitely not like a few years ago.

If its financed through the dealership just and the contract is bad just ditch the car at the dealership and dont pay.
