Bitcoin. At this point the main goal is to get a high enough market cap that major price fluctuations slow down. Bitcoin will be stable within the next 10 years and at that point will have unparalleled liquidity and be the crypto standard. All major business transactions will take place on the btc blockchain. Two entirely different use cases.
XMR is money you can keep safe from prying eyes and the tax man. Sure it has options for receipts/verification, but there's no baseline functionality for tracking payments.
BTC is money you can be 100% sure of, but which can be tracked and taxed.
If you were in Venezuela right now you'd XMR. If you were trying to buy a house in the US you'd want BTC.

What consequences? Monero is 100% legal and if they tried to ban it, they would have to ban bitcoin too because its free speech. just because you want financial privacy doesn't make you a criminal
