They're charging him with assault AND a hate crime, it's not a hate crime just to insult someone, it's a hate crime to do so while committing a crime SPECIFICALLY BECAUSE of their race. So calling someone a nigger and punching them is a hate crime, because you punched them for being a nigger, but calling someone a nigger and then defending yourself from them attacking you might be assault in Cuckifornia, but it is most certainly not a hate crime.
