Rosenstien's appointment order said Mueller was to continue the FBI's investigation into the Trump campaign, which was a counterintelligence investigation according to Comey's testimony to Congress.
Special Counsels can only be appointed to conduct criminal investigations per 28 CFR 600.1.
The Judge has demanded the unredacted second authorization letter secretly issued by Rosenstein. It's secrecy was established on the basis of it being a counterintelligence investigation.
My money is that the Judge will dismiss the case. Even if he lets it slide that Mueller and Rosenstein exceeded their jurisdiction, there is a clear procedure for counterintelligence investigations to refer evidence of a crime over to a criminal investigation, like they did with Cohen. That means Mueller impaneled a grand jury in bad faith. Bad faith filings are grounds for dismissal in any federal proceeding, civil, criminal, bankruptcy, immigration, etc.
