Except you cannot use old investigations that they deemed unfit to take to court against someone who already knows they would fail the test in court. In addition it is beyond the scope of the SC who can only bring indictments on discovery of new crimes crimes not discovered before.

That's what judge Ellis pointed out. The SC's reply is that there's some top-secret information that explains why they're totally justified. The judge gave them 2 weeks to produce all of their documentation and explanation, although if it's top secret it'll have to be viewed in a secure facility and won't be made public record.
