I am pretty conflicted on this whole scenario on the one hand the story is:

First of all, no it couldn't.
The gag order was (allegedly) to protect this from a mistrial by having a media ban so the Jurors can't be biased by outside sources. But that doesn't mean that any such breach would necessarily mean a mistrial.
There has to be a case made that sufficient information about the trial was leaked and then influenced the Jurors. Firstly that's impossible because it was the last day of the trial and none of the Jurors could have possibly seen the broadcast until after.
The details that Tommy streamed are already public knowledge, the media has already released that info to the public, and it's all on public ledgers that anyone who wants to look at the court logs can do so. He didn't say anything in the stream that the jury don't already know (names of suspects, what they're accused of, etc)
Lastly a case has to be made for a mistrial based on evidence presented, it's not just an automatic "you're let out of prison free" card. A judge has to look at what information was leaked and if that could reasonably influence a judge or jury, and it's obvious in this case, no, no reasonable case could be made.

His original conviction, though politically motivated, had a legal basis. His second conviction is spurious at best. It's one of the few charges and convictions that can result in summary conviction and jailing, allowing for appeal. Even then, it was handled in a very suspicious, most likely illegal manner.

Furthermore, the judge transparently lied about why he had handed out his judgement as he did, and then put out a press injunction to prevent anyone reporting on it. What Tommy was arrested for and what he was charged with were completely different things, and he had explicitly and on record confirmed with the police in the area that what he was doing was not, in fact, a breach of his court order.

Also, at what point is Tommy no longer video'ing these men arriving at court? Is it outside the Court? As they are coming up the road? As they got off the bus? As they left their house that morning?
