I think it should follow the same rules on expectation of privacy as any other photography. If the photographer takes steps to film somebody in a space where they reasonably expect that nobody will see them - i.e. a private residence with no view from public roads, a bathroom stall or changing room, etc. - it's illegal, but just walking around at the mall or on the street is fair game, as is a nude beach or a pool that can be seen from nearby buildings or whatever.
