Davis was about telling the fed (during bush's term, btw) that they can't indefinitely detain non citizens under order of deportation whom no other country will accept and that to detain for longer than six months the government would need to show either the special circumstances or that removal would happen in the forseeable future.
In other words, this is only relevant if mexico or some other south american country refuses to take the immigration, hence why a strong border protection policy is important to prevent them from getting in and causing this in the first place.
