Well no, as I understand it the bakery would fall under the classification of a place of "public accommodation" and therefore be subject to the federal Civil Rights Act and whatever anti-discrimination laws are upheld within the State that retailer operates in. As long as they don't refuse service on the grounds of any of those protected issues they're fine, though.
