Intent means everything. We dont have the SCOTUS to interpret laws based on the current understanding of the text. If the 2nd were interpreted that way, the SCOTUS would have never ruled that there is an individual right to bear arms.

The sticking point is "jurisdiction". The 1866 Civil Rights Act granted citizenship to people born in the United State not subject to any foreign power. The 14th amendment then clarified:
