It was actually Twitter. Twitter is trying to have it both ways. On the one hand, they claim safe harbor, which means that if someone slanders me on Twitter, I can't sue Twitter. However, in order to claim safe harbor, you can't exercise control of content unless that content is already illegal, like CP, death threats, incitement, etc.

On the other hand, Twitter claimed at various stages of the court case that it was the equivalent of a newspaper and a parade to justify why they could ban people at their own discretion.

Like I said, trying to have it both ways.

Facebook can be held to be a public accommodation, since they offer their services directly to the public. As such, they cannot practice viewpoint discrimination. Also, safe harbor provisions means that they have to be a neutral actor in order not to be sued for content they host.

Since you seem to be intellectually challenged, safe harbor works like this: If a newspaper carries an article that libels me, I can sue the newspaper. If someone libels me on Facebook, safe harbor says I cannot sue Facebook
