It was the prosecutor who went for the plea nit the judge. Its possible that the judge excluded a majority of the video footage as evidence but without checking the case file id have no idea. Doesnt seem like he did that though. Or would.

The point is that felony charges require something like 90% certainty. If you cant establish that, the guy walks and prosecutors hate losing cases. There Re plenty of arguments you can make to a sympathetoc jury which would lead to his acquittal. The sad thing is tbat this shows wearing a mask is highly effective at evading charges unless you are arrested on the spot.
