It is legally allowed to turn people back at the border even if they ask for asylum. Even if they made it into your country, you can push them back if the country they entered from is deemed safe. This is why Hungary can legally push everyone back to Serbia and Bulgaria pushes people back to Turkey and Spain, before the current commies took power, pushed back to Morocco.

ONLY if they reached your soil, not before. And then under the EU asylum directive, you can reject any application outright if that person is not fleeing Turkey, but fleeing some third country and then came to Turkey.

Two different concepts. You can turn them back at the border before they reach your soil (Spain has done this often in Ceuta). Once on your soil you can push the,m back if they don’t ask for asylum. Once they ask for asylum, you do not need to check whether they have an asylum claim because they are e.g. prosecuted in Somalia... but only if it is credible they are prosecuted by the Erdogan government, which is almost never the case. This is how Orban works the system, not one migrant is persecuted in Serbia, so they are all turned back within 48hrs if they reached Hungarian soil... even if they are Syrians or Iraqis or Yemeni.

I'm curious if there is any news about them trying to climb the fence and Spanish soldiers pushing them down or something. Hungary has a Schengen border and only polices its Schengen border to Serbia and Croatia (incidentally not protecting the Schengen border to Romania...). It does not protect its border to Slovenia or Slovakia or Austria.

"The 116 sub-Saharan migrants who entered Spain via the Ceuta border illegally yesterday (Wednesday) have been sent back to Morocco," the Ceuta prefecture said in a statement.

Internal borders are, no matter what people say here, costly to police and principally limit trade in goods and hold up legitimate citizens’ traffic... while illegal crossings are very hard to stop anyway, because they use sophisticated smuggle techniques.
The EU itself doesn’t give a fuck about anything... it is run by the few powerful EU states, essentially Germany, France, the UK and Italy have made all decisions in the last decades.
