Technically, the federal courts would have first crack at him. However, since the federal appeals process will take several years at the minimum (and historically is more likely to get a death sentence overturned or commuted to life), the state just wants to make sure he's not going to walk on a technicality. Basically, doubling down like this is a way of guaranteeing that he will never...EVER...leave prison as a free man.
