eadly reminder that stare decisis only matters until it doesn't. Wickard v Filburn, Plessy v Ferguson, Brown v Board, Roe v Wade are all cases that overturned decades of precedent. Antonin Scalia even wrote papers outlining the (high) standards by which stare decisis should be upheld or not. Overturning bad unconstitution precedent has not traditionally been understood as "judicial activism".
