Despite Democrat claims that we shouldn’t apply the beyond a reasonable doubt standard because this isn’t a criminal proceeding, almost every lawyer I’ve talked to doesn’t buy the argument. From an evidentiary stand point, her testimony IS evidence, but when you consider: 1) the time between the attack and now means memories can be blurred; 2) certain inconsistencies such as the number of people alleged to be present indicating her memory is flawed or fabricated; 3) the total lack of corroboration (her shrink and her husband don’t count because they only know of the incident from her) (it’s worth noting this doesn’t kill her case but it’s another nail); and 4) the political expedience of the claim, the probative value is significantly diminished.

Additionally, fun fact, but FBI has no jurisdiction to prosecute, and an “investigation” in this instance means essentially another round of background checks done through their database. They’re not some super police that can just swoop in and claim jdx on a whim. The only reason they were involved with the Anita Hill controversy was because the alleged conduct occurred on federal property, thus establishing jdx. We don’t have that here. We have an alleged private party on private property.

None of this is to even address the fact that this fits the definition of “bare accusation” like a glove. No specific time, no specific place, no third party witnesses. That every dem talking head has already convicted him the minute the story broke should provide all the evidence you need.

In one case you have a girl claiming a guy put his hand over her mouth and attempted to rape her, (age and age difference I dont think is relevant since its 15 &17), and anything sexual is immediately sound alarms for most people in the US.
