Probably not. Orange shirt guy repeatedly threatened to kill them while he was armed with a bat. The bat hit the dad, but it's hard to tell if that happened before or after the first shot. This is going to be a legal nightmare for Randy and his older lover. A wise prosecutor will play the angle that Orange was a fucking psycho and everyone knew he was crazy. They will say that Randy and his lover used his craziness as an excuse to gun him down.
