I'll explain the difference between jail and prison.

If you are arrested, you go to jail. Within a day or so, you appear before a judge, and the judge decides if there was a good reason to arrest you. If the judge thinks there wasn't a good reason to arrest you, then you are let go. If the judge thinks there was probably cause (or whatever the legal term is) then the judge will set the amount of your bail. Let's say the bail is set to $5,000. That means that you have to pay 10% of that ($500) to get bailed out, and if you flee to avoid court, then you have to pay the entire $5,000. If the judge decides you are too much of a risk, then you will be held without bail.

If you are found guilty, then the judge sentences you. If you committed a misdemeanor, you will usually spend like 1 year in jail. If you committed a felony, then you will usually spend over a year locked up. If you are sentenced to a year or more, you are sent to PRISON, not jail.

Anyway, to answer your question

The camera turns away during the initial shooting, so we can't see what exactly happened. If Aaron (the orange shirt guy) really did swing a baseball bat at the old man, then the shooting was self defense. Let me explain by talking about another court case.

In another court case (I forget what state), a man shot his son because his son punched him in the chest twice. You see, the father had just had heart surgery about 4 weeks prior. Think about it, if you just had heart surgery, and someone punches you in the chest, you would probably be in fear for your life.

So if you are an old man, and someone swings a baseball bat at your head, it is conceivable that you would be in fear of your life. If you are sitting in your car, and a man takes a hammer and starts bashing your car and your car windows, it is conceivable that you would be in fear for your life. If you are a 5'2" (1.57 meters) tall Asian and a 6'7" (2.01 meters) tall 260 pound (117.9 kg) man is physically assaulting you, you can conceivably be in fear for your life, and defend yourself accordingly.

You can clearly hear Aaron say, "Give me the baseball bat," and the wife turns the camera away, I'm guessing to hide the bat from the camera. Then Aaron either swings the bat or throws the bat at the old man. Aaron could easily kill the old man with a baseball bat, and he obviously threatened to do so.

It's going to be up to the jury to decide whether or not the Millers acted in self defense. It all depends on the circumstances that we don't know, that they lawyers on both sides will talk about. For example, did the Millers walk up to Aaron wielding guns, looking for a fight? It looks to me like Aaron was being the aggressive one. This youtube comment sums it up nicely:

They are pretty much screwed as self defense and stand your ground laws still have requirements of reasonable force. The father shoots first when the guy with the bat is still too far back to be seen as a reasonable threat to the point of using deadly force (debatable).
Then as you can see in the video the orange guy turns his back towards the shooters and is moving away, the bat gets flipped at the father and then more shot at a now unarmed and fleeing person who dies facing away from the shooters.
The son was the worst offender as he unloads with the shot gun after the other guy no longer even has a weapon. I mean best case, maybe it's self defense for the first two shots of the father, but after that it was already over as far as self defense goes. So a lot of this will come down to the medical report as what shots killed orange guy

Yeah the legal term that gets used is reasonable force, reasonable actions and so on. The problem is for your average person they sort of blur the legal requirements and protections given to police with that of private citizen and if it's your own property or now and so on.

I actually don't have a clear answer for this either. In my concealed carry class (I live in Texas), they told us:
-ONLY draw your gun if you feel your life is in danger
-ONLY draw your gun if you intend to shoot

I asked the instructor if I have the right to shoot someone trying to steal my car, and the answer the instructor gave was intentionally ambiguous, as if to cover her ass. Her answer was basically, you will end up in court and spending thousands on a lawyer, but that doesn't actually tell me if I can defend my property or not.
