It's more of an extension of the original case for contempt of court because referring to Islam here is considered one of several ways of trying to negatively influence how people see the defendants. Prejudicial here being prejudicing the jury, not racial prejudice. That was actually how they decided to proceed at the time when they bailed him back in August.

It is pretty fucked up, but it's also completely standard to get 'credit' for a guilty plea under 144 of the CJA. The trial clearly wasn't at risk though when you have all these other people reporting on it. If a trial is genuinely 'at risk' from someone standing outside a court reading a newspaper then I think there are some bigger problems to be dealt with..

Close enough to being a risk that the defendants arguably would have a case for appealing, hence Tommy's "deep regret". You could say they already had a case from the trial being reported on at all, but at best you've strengthened that case. It's not that it makes the rapists any less guilty, it's the time and the fuckton of money you waste putting them on trial all over again.

Most of all need to clarify (or preferably throw out) the absolute fuzziness of a lot of the laws they've brought in over the last five years where 'hate speech' or 'terrorist material' can be defined on ad-hoc basis to mean whatever they want it to mean. Another point is, the entire system here with 'reporting restrictions' is silly anyway. In America you sequester a jury for the trial duration, you don't sequester the entire country. As I say, if someone reading the news outside a court on a public street is enough to put the trial at risk then you'd see cases being thrown out constantly because all you'd need to do would be have some guy stand outside the court shouting and then the whole thing would be over.
