Leaving the scene only to return with a weapon looks reeeeeaaaallllly bad in front of a jury when trying to claim that you feared for your life. Plenty of self-defense claims have been invalidated on that element alone. That's the thing. Returning with a weapon really strains a stand-your-ground defense because you have to articulate why you decided to return with a weapon. Holding a handgun openly (even if not pointed at someone) is frequently identified as brandishing; it's hard to see a circumstance where a civilian entering an argument with a handgun already drawn isn't indirectly threatening his opponents, even in a gun-friendly state like Texas.

So returning to an altercation with a weapon in order to "defend" someone who (it could be argued) was threatening others is not the smartest idea. It doesn't make them guilty of murder, but father and son helped escalate a stupid argument. That's not a good thing to do if you possess a firearm.

What prosecutors do is overcharge, and then offer you a PLEA to take a lesser charge like manslaughter. It's really hard to resist for guys like this who are facing 20+ years in prison for murder even if you and I know there is no way they'd get convicted. Hopefully they hold firm and the Texas jury tosses the shit out.

The point I'm trying to make is that "barrel-down" IS still considered brandishing in a wide variety of cases and in most states; you don't always have to point the firearm at someone to cross that magic boundary. Open carry activists in the US routinely carry rifles on their person, but if you look at any protest videos, they are often EXTREMELY careful not to hold their weapons in their hands; instead preferring holsters and slings. They are even more wary in front of police precisely because the police don't have a hard time interpreting a drawn weapon as a threat. Carrying a weapon in your hands IS considered a "drawn weapon".

Walking outside to confront someone with a holstered pistol can communicate a very different intent than walking outside with the pistol already in your hand. The same thing applies with carrying a long gun in your hands into an ongoing dispute.

Video started recording some time after the altercation began to happen. So when the video started to record and the two shirtless guys had their weapons in hand, it may have been as a response to threats or aggressive behavior from Howard and not unprovoked brandishment. As far as we know the weapon may have been in his waistband before the camera started rolling. But that's not the point, Howard was warned several times not to cross a certain line and yet did so by swinging and throwing a bat at Boomer Sr. This is the whole point of contention, whether shooting him then and there was justified or not, because both parties were equally guilty in fanning the flames of the dispute and escalating the situation.

All in all it was a situation where no one needed to die. In any other country it wouldn't have resulted in a fatality. It might've been a fist fight or an assault or a stabbing, which yes can lead to death, but this incident ended with a shotgun blast to the victims head, over trash.

From what I've read on this argument, the mattress could not be against or near the dumpster because the garbage collectors can't be bothered to do any extra work like move a mattress away while collecting the garbage (public sector union rule #1A "employees may not do any actual work besides press buttons labeled "Fuck the Taxpayer" over).
