Not to get off topic, but Toobin is wrong in this article. Madison and the other writers of the constitution believed in the idea that all three branches could declare a law unconstitutional. This is called concurrent review and it wasn't until the courts stole power through Marbury v Madison did this change. Madison describes this in Federalist 49 and then again in 1834. Jefferson also believed in this and found the idea of the judiciary being the sole arbiter of constitutionality abhorrent.
Hopefully when Kavanaugh gets confirmed, the Roberts 5 can once and for all correct this error by John Marshall.
