The act of shredding wasn't part of the artwork - it was the art.
Sothebys had to know that was going to happen. There is no way they didn't know the frame contained the shredder. Because it had to have been checked to make sure it was going to activate properly - no corroded terminals or dead batteries. If it didn't activate - then I suspect 'Banksy' would have temporarily withdrawn it from sale, or some such. Somebody had to throw the switch, but they had to know the mechanism was going to work.
Sothebys contacted the buyer and explained that it was part of the piece he'd just bought, and that it wasn't broken, and please don't sue them, because he bought the piece (the shredding of the print), exactly as 'Banksy' designed it to be appreciated.
Still clever, but not the total surprise everyone's claiming with not-very-straight faces.
