Are they out of jail for the second time, or are they still in jail waiting for the judge?

The Millers started the fight, and escalated it by drawing firearms, but it was Howard who was making death threats, and it was Howard advancing on them with the baseball bat that provoked the shooting. The murder charge stems from the final shots, which occurred after Howard threw the bat and apparently struck the elder Miller.

The Millers might be justified here: Howard attacked them with a weapon and they fired in self defense. The only issue clouding it is what responsibility the Millers bear for starting the fight. I think whatever happened leading up to the shots fired, once Howard made clear death threats, armed himself with a bat, and attacked the Millers they were justified.

It appears one of the main reasons this is in the news again is it is some editors effort to blame Texas gun laws for the incident.

It is clear from the actions of the useless people involved that the gun laws are the least of the contributing factors.

On the morning of Sept. 1, Box and Howard were in the backyard when they saw the mattress was on their property. Howard tossed it back in the dumpster.

The bat entered the situation after the guns, not before. The bat was thrown over the Miller's heads, not swung at them. The bat was held by a brother off camera, not Aaron, the man who was shot. Shots were fired into Aaron after he had fallen.

That is all murder by the standards of the law in Texas. If the shooting is not on your property you are only allowed to fire to avert a threat, and Aaron was not an imminent threat at the moment of the shooting -- particularly the final shots when he was on the ground. After shooting Aaron the Millers held their weapons to Aaron's wife's head and flattened her to the ground.

They will go down for murder. It may not be 1st degree, but this is by no means a "clean shoot".

(I grew up in Texas, by the way, and served on a jury for a similar case in Dallas several years ago -- I don't think the law has changed too terribly much since then.)

The theory in the press (which could be very inaccurate -- we can only know right now what is in the video, and the status of the bat is entirely unclear from the video other than we don't see Aaron with it) is that it was only thrown.

The status of the bat is unimportant, however, in establishing murder. The shots continuing after Aaron was on the ground are murder all by themselves, regardless whether a swing initiated it.
