I heard back from the US state department, I was told the following yesterday:
1. My chances in Canadian courts were never very high just going through their legal system.
2. The most common allegation in Canada towards American men is abuse
3. The rules for evidence in Canada are such that a women merely claiming abuse with no evidence or witnesses is enough for most Canadian judges
4. If I get the FBI involved (it is kidnapping under the law in both countries to remove a child from the country of residence to sue for custody in another country) my Hague application will likely be rejected by the Canadian Hague court on the grounds that it is traumatic for a child to see their mother arrested and since I will be the one who got law enforcement involved I will be considered responsible for that trauma and thus deemed an unfit parent. The US State Department official reiterated that his job is just to prepare me for how the courts up there work, not that he agrees with it after telling me this.
5. My best chances are to continue with the Hague application and then call the FBI anyway if the Hague judge does not accept my petition and then apply for custody through the normal family courts in Canada while my wife is in US federal prison, if I do that and they deny me anyway my daughter will possibly end a ward of the state.
