This will inevitably reach the SC and it’ll come down to these judges. If Gorsuch and Kavanaugh vote against AA then it’s gone for ever. It’s likely that it’ll be phrased (as per the request of the Asian students) that applying for any organisation or job race must not play a factor at any point in the acceptance measures potentially ending not only affirmative action but all forms of diversity quotas as well. Let’s not forget about the potential for the Damore case to get that far also
