Not the poster before so never claimed it was a hate crime, which it isn't, though let's be honest if a gang of white guys went out raping black girls for basically the same reasons (i.e not christian or white, won't offend other whites and they find them attractive) then they'd be likely charged for a hate crime. 'Hate Crimes' aren't even particularly weel defined and plenty of assaults get assigned as hate crimes despite pure coincidence. I personally don't think such a charge should exist since it is based on the motive, which shouldn't factor into the charge. Only the criminal act itself should bear the charge, a precedent that english law held since Saxon times.

I agree to a certain extent that no judicial decision is copy / paste but I think excluding motivation behind a crime from the crime itself is not what it's about, it is always connected.
There may have been people wrongly sentenced for hate crimes and vice versa, that doesn't make this specific case a hate crime just because, as you said it's not either / or.
