The problem is that sex and gender are used in legal code, and historically they have been used interchangeably.
If we are going to use these concepts for legal purposes we must have clear definitions for them.
Either remove the concept from the legal code, or set hard workable definitions for these ideas.
You can't have both. "Gender is a spectrum" doesn't work in court.

There absolutely is a scientific basis for race. Races cluster extremely discretely and moreso that different breeds of most animal species do. Geneticists can predict with 98% accuracy how an American will self-report their race based on looking at their DNA. The 2% discrepancy, while tiny, is actually accounted for by the mistake in the self-reporting

Gender binary is not a cultural construct. Chromosomes are biologically defined, and the vanishingly small number of exceptions (most of whom are infertile) are abberational mishaps: some people are born with 6 fingers but we still correctly say that human beings have 4 fingers and a thumb on each hand.
