Also, the SCOTUS majority writer for the Ark case was on the same majority that wrote plessey v. Ferguson which was also overturned due to its failure to abide by the constitution framework. It is absolutely true if teh States adn the people choose to assert their rights. if they don't then you are correct that the war nullified it. But even now we actually see States nullifying fed laws and showing that the 10th amendment is still alive. South Carolina has nullified obamacare stuff. Kansas has nullified fed gun laws. Many many states have nullified fed cannabis laws and legalized the drug.
