Yes, you can refuse to take the tastes, but nothing stops the law to say you can't if you don't take the test. It's like Lei Seca; you can refuse to take the test, but the police can take you in from appearing to be drunk.

I think tests for public office also require toxicology exams if I remember correctly, so it makes even more sense.
I don't know on what the law is based on, but you require a toxicology exam to get and renew a CNH, I think some other types of professional drivers require it too, like cabs.

The test if hair test, so they get your hair right then, it can detect for something like 90 days.
