1) the Pentagon is not able to "refuse" anything from the President. Its more likely they advised the POTUS on what he has to do to make it a lawful order 2) Posse Comatatus (sp) os the legal term the prevents Federal Troops from enforcing civilian laws. 3) the Patriot act and this specific situation make this a VERY murky call for the military. 4) the work around is US Troops be put south of the borders -or- declare martial law and or a state of emergency in the border region. This would make Trumps ORDER (POTUS does not make requests of DOD) lawful.

Its a liability because then the federal government is on the hook for trying to perform an action outside of their directives or jurisdiction.
