Only the backstop includes a customs union, the political declaratoon says free trade arrangement without tariffs, limited services access, not free movement, no customs union and only limited harmonization of single market rules. It’s pretty much how the Canada-EU deal works.

I think they essentially still follow EU trading laws, which basically means the rest of the UK does too, and when the time comes to leave we have to ask permission of the EU to change this, and you are not legally obligated to accept a change. So we would be tied legally to the EU with no way out.

The backstop means if no agreement is reached by 2020 we can only leave if both parties agree. We all know this means the EU can drag their feet and never reach an agreement because unless they say so we will continue to pay into the budget and remain under ECJ jurisdiction plus maintain a legal alignment between NI and ROI.

There is absolutely no way in hell that the backstop ever gets implemented. First, it is flawed by design for both sides, second it is politically untenable for the UK, Ireland and Europe and third, there is no reason whatsoever to finalize the FTA for the UK-EU until 2021 and that solution is by far the best for everyone.
