It's legal if you have the info cc'd to a govt account. This is more about the foia than anything. Classified info on a private email is illegal either way.

She was also a trained high ranking government official. It was specifically illegal for Hillary to set up an unregistered unregulated private server on account of it circumvented public record. Then she broke national security by transmitting and storing SAP information. Hillary intentionally and in a premeditated fashion broke the law directly against the purpose and intent of the office she was sworn to uphold.
