Flynn “interview” was never documented because it was an illegal operation. The inly documentation they have on it is dated aug of 17, the “interview” was conducted in jan 17. 7 months to file a mandatory document? This is what getting your lies in line before signing your name looks like.

The reason there was no 302 is because Agent Peter Strzok of the FBI, who was the No. official in the Counterintelligence Division at the time of the Flynn interview, was gathering INTELLIGENCE on Michael Flynn by asking him questions, which would be INADMISSABLE in a CRIMINAL INVESTIGATION.

A 302 is a written report on an interview conducted by the FBI. For some reason they don't have to actually record the interview. A federal judge told Mueller to hand over the original 302 of Flynn's interview. Instead, Mueller handed over a 302 of Peter Strzok discussing the Flynn interview from 7 months AFTER the interview actually took place. Strzok made the 302 like 3 days before he was fired, and after his alleged mistress had already been fired.

The real reason Mueller publicly said not to give Flynn jail time was to get out in front of the eventuality that Flynn is not punished because the evidence against him is too weak, and the charge is very dubious. Now when nothing happens to Flynn people will claim it's because Mueller said not to do anything to him.

Another key issue is determining the legality of the evidence in the first place. I think it's somewhat likely that Peter Strzok, being the no. 2 Intelligence officer at the FBI, would be conducting a COUNTERINTELLIGENCE OPERATION. Thing about those is, evidence is not admissible in court (w/o a duly executed search warrant.) So...if there's no warrant, if there's no investigation, what are Strzok and the other one doing there collecting evidence for a criminal investigation? Michael Flynn has 4th Amendment rights just like everyone else.

Would also explain the failure to file the original 302 - if it wasn't admissible or never created.

What are the odds that the Flynn charges arise from non-admissible FISA intelligence (remember: two hops) gleaned from a fraudulently obtained FISA warrant against Page?

The overarching theme of all this Flynn/Page/Manafort/Cohen/etc. saga is this: none of it indicates any evidence of collusion whatsoever. IMO it's quite possible Rice (and obviously other senior Obama Administration officials) were trying to cover Strzok's tracks for the incoming Trump Administration.
