Be me

>Be me
>18
>Throw party at my house
>friend invites 15 year old girl
>Alcohol is involved
>Didn't know her age
>She's flirting with me the whole time, eventually shes all over me
>she asks to go back to my room, she's tipsy but not enough to where she's black out drunk
>We have sex, she consented and was fully aware of what was happening
>Cops show up today, she claims that I raped her

I have 3 people who heard her ask to go back to my room and 2 who heard her give consent (They were at my door and heard her say mhm when I asked her if she was sure she wanted to do this). I've read up on something called Romeo and Juliette laws and it basically protects me against a felony, but I'm not sure if it applies to me since she was UTI even though she gave consent.

Any advice?

If cops really did turn up then you wouldn't be here posting about this on Jow Forums. Fuck off with your LARPing.

They brought me in for questioning.
Also
>They demanded the seizure of my bed sheets, and cups, and condoms
>Said that if I didn't comply, they already had a search warrant written
>Took my bed sheets, pillow cases, and took pictures of my guns and house
>Dragged me to their office for questioning. Never asked me about my attorney, Miranda rights, ect
>Practically bullied me into confessing

Bump

Too bad you don't have autism op. Every time I have been questioned I say, "let me call my attorney." And they leave you the fuck alone. They didn't have to read you rights or offer youbrepresentation because you weren't under arrest and went voluntarily. Also it doesn't matter if she consented because she's underage. You're fucked.

Well you should have said:
“I want to speak to an attorney”. The moment you saw them.

And always make them jump through the legal hoops. Don’t volunteer or give them permission, make them get or use a warrant.

Where are you anyway? At least in California they have to prove that you knew she was underage.

Did you tell your parents? You should have told your parents.

You're not one of those "Thin Blue Line" and "Cops never do anything wrong!" fags, are you? Because the police are generally not your friend. When you need their help they're usually too busy or don't care but when YOU fuck up their up in your shit trying to fuck you over to pad their numbers.

If they had a warrant, they would've just fucking presented it.

If they were doing things by the book they would've mirandized you.

They probably saw 15 year old girl + party + alcohol and decided you were guilty before they even knocked on your door.

Let that be a lesson to everyone else: teenagers are fucking retarded.

Hope it was a good fuck because now you can think about it every time or have to reregister as a sex offender for the rest of your life... and anytime a young girl goes missing near you, the cops will be banging on your door.

Way to help them build a case against you...

>Any advice?
Bulk up, quick. Jailmates don't take kindly to """pedophiles"""

>Said that if I didn't comply, they already had a search warrant written
lol what a dumbass, never believe anything a cop says.

Georgia

In Georgia, the age of consent to engage in sex is 16. However, there can be no conviction for statutory rape in Georgia based only on the unsupported testimony of the victim. There must be some additional evidence. This might include physical evidence, the testimony of another witness, or the admission of the offender.

The penalties for violating the statutory rape laws in Georgia are quite stiff. For a “standard” case of statutory rape, the penalty can range from 1 to 20 years in prison. If the perpetrator is over the age of 21, the penalty is 10 to 20 years in prison.

If both parties are under 18, and there is less than a 4 year age difference between them, it is still illegal for them to have sex in Georgia, but it is treated as a far less severe crime.

Dumbass, you basically hung yourself...

She told me and another guy that she was 16 on our way to my house. They have DNA evidence, a condom I used, and the bedding plus alchohol cups.

Yes, you handed them a case... if you would have cleaned up after they left to get a warrant you wouldn’t even be arrested on Monday.

I was never arrested, they forced me to go with them to the office and give a statement

>Play a teenager with alcohol
>Fuck her
>It's not rape, r-right?
You dumb motherfucker.

Yes, because they know the prosecutor can’t get a conviction without evidence, you gave them their entire case against you. So after processing the evidence and talking to the DA, this coming Monday or Tuesday expect to get arrested.

Fuck, is there anything I can do to help my case?

I live in Georgia too and I can tell you they did not force you to do anything. When police force you to do anything handcuffs and pain are going to involved. If they didn't handcuff you and literally drag you to their station followd by booking you, then volunteered the information they needed to build a case against you. Since you willfully gave them this evidence you have substantially skewed the case to the states favor.

You need to suck it up, tell your parents and consult a lawyer ASAP. The police are not here to help you or tell you the truth. Police are actually trained to lie and trick you into telling them want they want to hear. A lawyer may be able to get evidence thrown out using the search warrant threat in a legal maneuver when it goes to trial in which case it would become something of a he said she said case with you having (hopefully) corroborating witnesses on your side.

The important thing here is
1) you already messed up big by talking to the cops so do not talk to them any more.
2) Get a lawyer now, and make sure it's a good one.
3) The most important thing after getting a Lawyer... DO NOT TALK TO THE GIRL

So talk to the girl before getting the lawyer?

This is why your people lost the war...

Not OP

I'm afraid you're in some shit, mate. I doubt you'll go to prison for multiple years but this is going to be a bad few months, I can almost guarantee it. In Florida if you did this you would be 100% liable for a felony and "Romeo and Juliette" would only keep you off the sex offender registry when you got released. I know a guy who was basically in your same situation, fucked a 15 year old at a party, people saw him go to do it, and he (pointlessly) confessed. I don't know exactly what happened but his life was fairly fucked up, he got put on some kind of program and I never saw him again. This kid was a high school sophomore so you are definitely in a lot more trouble as an adult.

I mean OP could talk to the girl first if he wants to go from digging his own grave with a shovel to using an excavator and make sure he goes to jail.

At some point a lawer would defintly request an inteview with the girl in the situation but it will likly be without OP present. Best advise to the situation is lawyer up and dont talk to anyone involved in the case. If the OP said no to the initial request for search and the police responded actually saying "We have a search warrent written up so let us in" when they did not have it present or signed it should be easy for a half way decent lawyer to get the evidence thrown out. At that point it would now be a case of the police misrepresenting the situation and violating OPs constitution rights against police searches.

You supremely fucked up. Not saying that the punishment fits the crime here but this is all a result of your series of extremely poor decisions. You're going to have a really difficult time convincing anybody that throwing a party at your house, inviting minors, getting them drunk and having sex with them was some kind of crazy coincidence. You're the legal adult. It was your house. It was your party. That makes you responsible. Sorry, bud.

If it makes you feel any better if you're this stupid and careless you were bound to end up in jail sooner or later.

Maybe, just maybe a plea deal to give up who got you the liquor...

This!

I'm not a lawyer but I doubt that any prosecutor is going to be interested in dropping the felony sex crime so that they can go after a misdemeanor furnishing charge. That doesn't make much sense. I highly doubt that the person who purchased the alcohol is even on their radar.

This except I would add that even if that was an option you'd be a piece of shit for ratting on someone who committed a minor infraction for your benefit instead of taking the blow for something everyone knows will get you in deep shit and failing to handle it correctly.

Remember it’s Georgia...

Serious answers only please. This is a very stressful situation and the last thing I need is smug comments

You're more fucked than the girl you raped.

You fucked up and now your fucked. Nothing you can do.

But because it was an instrument used to allegedly commit another crime, they may be able to add additional charges or accessorie charge them.

What do you have to gain from posting shit like this?

The knowledge that I made someone's day a little better.

how was it tho OP?

You should have known not to do this because of all the suffering and humiliation you saw other men in the same situation go through, just shows we need to be louder about it.

Why the fuck would you have sex with someone you just met and/or don't even love?
Classic normies.

Attached: l2a1downsized.jpg (1024x768, 370K)

It's usually a lot better than nothing, I've fucked several girls but I've never really loved one.

>Said that if I didn't comply, they already had a search warrant written
Which means you consented to the search and it's exceedingly unlikely you could assert there was an unlawful search, thereby getting any physical evidence excluded.
>Dragged me to their office for questioning. Never asked me about my attorney, Miranda rights, ect
Dragged as in arrested? But you were released? Were you arraigned and bailed? Or were you just cut loose? Because it doesn't sound like you were under arrest, in which case you weren't entitled to hear your miranda rights. You could've left at any time, at least in theory.

You need a lawyer. Right now. Maybe there is a way to staunch the bleeding at this point and plead out to something like furnishing alcohol to minors.

Good luck.

>However, there can be no conviction for statutory rape in Georgia based only on the unsupported testimony of the victim.
He already said he told the cops he slept with her. That's enough for a conviction.

And that's even if he could get the search thrown out, and it doesn't sound like they can.

It really depends on how insistent the victim is that she was raped vs. it being stat rape, plus the surrounding circumstances. I mean, if he genuinely thought she was legal and there's no indication it was forcible, I can see it getting pleaded down to furnishing.

Despite prosecutors and cops having a reputation for wanting to stick it to perpetrators, they genuinely have a heavy caseload and they are greatly incentivized to plead down most cases.

Hell, even if not down to furnishing, they could potentially plead it down to a sex crime that doesn't involve registering as an offender. Prosecutor has tons of discretion.

exact opposite of me

Which is why I said: >Yes, you handed them a case...

This.

I live in Georgia and have been hauled in for bullshit. You should have asked if you were under arrest or should have asked for a lawyer. Also why would you even let them take the evidence when they didn't have a warrant? NEVER let a cop enter your home or car unless they specifically have a warrant and ALWAYS have audio or video recordings when they talk to you, just don't be in their face about it.

opposite for me too. I'm too ugly for casual sex

Where can I get a gas mask like that?

Despite what armchair law experts on the internet might say, you don't actually have to have your miranda rights read before getting arrested.

>We have sex, she consented and was fully aware of what was happening

If she was drunk she can't consent, end of story.

I had a judge read them to me before she asked me questions because she said it was possible that there could have also been another case against me, possibly criminal. So after that, I did not answer any further questions...

Hijacking the thread here. Went to a friend's house today to watch the WC, 15yo started hitting on me. I'm 19, age of consent here is 14. Should I or will partyvan show up on my door?

Damn I thought this was a larp.
In case of this is real, ya dun goofed, really.
Get a lawyer asap

Check the law more carefully. Age of consent might be 14 only if both parties are under 18

I did that, and there's no problem, it only matters if both parties are over 14. So, is it ok?

It’s still risky. Often, minors whose parents find out that they had sex will pressure (or confuse) the child into believing she was victimized or even assaulted.

It’s not mandatory to get mirandized before arraignment (at least for constitutional purposes; many states require it by statute), but it’s valuable because without it, any confession can be thrown out.

Yes, that is what makes me afraid. I think I'll just make out with her and play it safe.

>18
>Alcohol is involved
I wonder why you thought this was a good idea

Sigh. You dumb. Odds are your state doesn’t require penetration for it to be molestation or something else.

How do you think parents find out these kids had sex? They don’t check their hymens at random.
>Daughter was out all night
>WHERE WERE YOU
>[several hours of grilling later]
>Daughter has told them she was with friends, then mixed company, then at a boy’s place, then which boy, then admitted you kissed, but deny more
>[several hours of grilling later]
>Daughter is convinced you tricked her, that you touched her even if you didn’t.
Parental coercion is super fucking powerful and it happens all the time.

Don’t mess with unemancipated minors.

You're also an idiot and sooner or later you're going to end up in jail next to Jaekwon where sweet justice will be served. Leave 14 year old girls alone you retard.
