Judges can't stop someone from doing anything until someone files a lawsuit anyway.

Basically, Trump can declare a national emergency, and the only people who could do anything would be 1. military contractors who had their promised money taken away to go to the wall or 2. people who had their land seized.

At that point, they could sue and the wall would be stopped and put on hold for a few years while the court case goes through.
