That's why in the defense industry, we call it "less lethal", rather than "non-lethal".
Another good example is tasers. Ever noticed that when they do a demonstration, the guy getting zapped gets shot in the back with it? Most instances where a taser is actually used will hit the front of the target, though. If they have a bad heart or neurological issues, it's not all that uncommon for it to kill them.
