you have 400ft above you own house as privet property and air space. planes are not allowed to fly less than 2000ft unless landing, taking-off, or with the permission of the land owner and can be sued (for not meeting FAA safety laws). this is not true for other small craft it is akin to someone driving on the grass by the road in front of you house, legal but only by so much.
