That was the issue, but what it would usually result in is that these lawyers would argue bullshit and split hairs to the point where they would be found guilty but get a deferred sentence or a heavily reduced one so they only pay a fine and see no jail. If the evidence was against them, they wouldn't be found innocent but it didn't matter since nothing happened to them. Now they're guaranteed to serve at least 5 years in jail as the minimum sentence unless they can be found innocent and that's very rare.
