Technically speaking Germany was not obligated to declare war. For example Japan didn't declare war on Russia when Germany invaded them. In fact Japan let Russia ship supplies from America unmolested throughout the war.

Except that Germany was effectively in a naval war in the North Atlantic with the US since 1939. The German Navy wanted a formal declaration to free their response. Hitler acquiesced because he expected the US to focus on Japan.
