Theft/Fraud and Assault. Legal Help

Someone committed fraud against me regarding selling me a phone that wasn't actually paid off. When I replied that I was going to file fraud against him, he made realistic threats of violence.

I called the police and they said this he is only "harassing me," and that selling a phone which hasn't been paid off as being paid off is not theft or fraud because I could have gone to a store and checked that it wasn't paid off.

This is fucking bullshit. I filed harassment against him and the officer was sympathetic his the woman who oversees him said that it's all a civil matter.

I don't even know where this guy lives in order to serve him.

Is it seriously not a felony to threaten violence against someone as a way to scare them into not suing you?

It is and the police officer was of course retard. Get lawyer. And if i mean get lawyer go to lawyer office right now say what you are telling to us. They will tear you apart with ez case like this.

Im not from America. But knowing your legal system at least basics of it the legal term will be "racketeering" which is also federal crime worth 20 years in prison. Again im not from America but if i was i would 100% get lawyer on this.

So a couple things...

First, it isn't assault unless he makes a threat that leads to you believing that an attack is going to happen right then. He's doing this over the phone. Obviously he cannot attack you if he is not near you. Thus, in Missouri that's harassment. If the police are actually investigating this you might be able to ask them if they got an address for this guy. If they let it be known that they have an address but they don't want to give it to you, you might be able to get it by filing a Freedom of Information Act request for information related to the report.

While the police could make an argument that if this guy told you the phone was clear of any contracts that this is fraud, if you don't have something in writing or a recording of him saying that, it's not worth their time to pursue because there's no actual proof.

And you should have taken the step of checking it.

I bet you also don't have a receipt from this guy proving you paid him money.

Probably how this is going to end up is a lesson in not letting your greed make you stupid.

You can try to sue him in small claims, as hiring a lawyer would cost more than the phone is likely to be worth. Good luck getting a lawyer to pick up something like this on contingency because they're going to assume that someone ripping off some other dude on a cellphone is likely broke and wouldn't be able to pay a judgment anyway.

You can sometimes sue with incomplete information and use subpoenas to find an address or real name. I'm not sure if you can do that in Missouri for small claims, and a lawsuit in civil court can be much more expensive.

It is in writing:

Hey, what was the original carrier?

He also marked the item as sold and replied to me after I asked him to call Boost to unlock it. This proves that he sold it to me. It was also directly in front of a gas station with cameras.

What now?

You can try writing a letter to your attorney general and see if they feel the same way.

If they do, you need to deal with this as a civil issue, not a criminal one. That means taking him to court.

Just fight him. There is no legal recourse, he's going to walk away clean. If you want him to pay, you're going to have to make him pay. To him, you're nothing but a typical harmless white boy who thinks he's smart but has no real sense at all. A soft, unassuming target to exploit whenever he wants, like the rest of your kind.

I did this because small claims court says that you must prove that you attempted to resolve the issue before bringing it into court. I expected him to ignore me, at most. I did not expect him to respond with threats of violence.

I would contact the next department of police and also report how you were treated by your local police.

You don't need a SIM card to check if a phone is reported lost or stolen, or if it's showing up on your carrier as clear to activate.

If you don't have the means to do this in front of a gas station, you tell him to meet you at the AT&T store and check it there. If someone's not willing to do that, then you say "sorry, I'm not going to buy your phone".
